Terms and Conditions of Trade

General Provisions

  • Any service or parts orders placed by the Customer are subject to the terms and conditions stated herein, unless specifically varied by Palm Wheel Alignment in writing.
  • Palm Wheel Alignment’s terms take precedence over any conflicting terms in customer documentation.
  • These conditions shall prevail unless specifically varied by Palm Wheel Alignment in writing with reference to the customer’s contrary documentation.

Work Orders and Undertakings

  • Work Orders: Basic services are quoted as stipulated on Job Cards signed upon vehicle intake.
  • Timeframes: Quoted timeframes are based on primary diagnostics.
  • Execution: Services are executed by trained employees or appointed associates.
  • Service Standard: Professional service will be provided as efficiently as possible.
  • Feedback: Regular updates will be given regarding progress.
  • Workshop Safety: Vehicles may only be driven by qualified employees.

Responsibilities of the Customer

  • The customer shall provide appropriate cooperation and assistance.

Fees and Expenses

  • Calculations: Fees are based on parts and labour at agreed rates.
  • Exclusions: Travel and out-of-pocket expenses are excluded unless specified.
  • VAT: All prices exclude VAT at the legally prescribed rate.
  • Rate Reviews: Rates are reviewed periodically.
  • Extra Work: Additional work requires confirmation.
  • Errors: Accidental errors or omissions may be amended.

Specifications

  • Descriptions and illustrations may change due to improvements.
  • Descriptions are not binding and represent general service types.

Limitation of Liability

  • General Liability: Limited to the amount charged for the service concerned.
  • Consequential Loss: No liability for indirect or special damages.
  • Third-Party Work: Subsequent external work voids warranties.
  • Indemnity: Customer indemnifies Palm Wheel Alignment during work performance.
  • Advice: Advice is given in good faith; customers must apply their own judgment.

Payments

  • Terms: Payment is strictly COD unless otherwise agreed in writing.
  • Right to Withhold: Vehicles may be withheld until payment is received in full.

Timetables and Estimates

Completion time depends on factors outside the control of Palm Wheel Alignment, including parts availability.

Health and Safety

  • Customers must observe safety regulations.
  • Yellow demarcation lines indicate safe zones.
  • Approaching ramps or standing under vehicles is at the customer’s own risk.

Insurance

  • The customer must provide adequate insurance for their vehicle.
  • The customer indemnifies Palm Wheel Alignment against all related risks.

Non-Inducement

  • The customer shall not solicit or entice away subcontractors, suppliers, or consultants of Palm Wheel Alignment.
  • This restraint remains in effect for 12 months after termination of the agreement.
